Right of withdrawal

1. Statutory right of withdrawal

Consumers generally have a statutory right of withdrawal for off-premises contracts and distance contracts.

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day

  • on which you or a third party named by you, who is not the carrier, have taken possession of the goods, or
  • in the case of a single order for several goods that are delivered separately, on which you or a third party named by you, who is not the carrier, have taken possession of the last goods.

2. Exercise of the right of withdrawal

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

3. Consequences of withdrawal

If you withdraw from this contract, we will reimburse you all payments we have received from you, including the costs of delivery, with the exception of any additional costs arising from your choice of a type of delivery other than the least expensive standard delivery offered by us.

The refund will be made without undue delay and at the latest within 14 days from the day on which we received the notification of your withdrawal. However, we may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

For the repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. You will not be charged any fees for this repayment.

4. Return upon withdrawal

You must return or hand over the goods to us without undue delay and in any event no later than 14 days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the period of 14 days has expired.

You bear the direct costs of returning the goods.

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that was not necessary for checking the condition, properties and functionality of the goods.

5. Voluntary 100-day return policy

Regardless of your statutory right of withdrawal, we voluntarily grant you a 100-day return policy from receipt of the goods.

This voluntary return policy applies in addition to the statutory right of withdrawal and does not limit your statutory rights. The statutory right of withdrawal remains unaffected by this.

A prerequisite for a return under the voluntary 100-day return policy is that

  • the goods are complete,
  • undamaged,
  • without signs of use,
  • free of defects that did not already exist upon receipt,
  • and, if possible, in the original packaging

are returned to us.

A refund under the voluntary 100-day return policy will only be made if the goods arrive in a resalable condition. If the goods are damaged, incomplete, dirty, used or no longer in a salable condition, we reserve the right to refuse the return under the voluntary 100-day return policy or to make an appropriate deduction.

The customer organizes and pays for the return shipment under the voluntary 100-day return policy themselves.

6. Return of defective or damaged goods

If the goods are already defective, damaged upon receipt or the wrong goods were delivered, your statutory warranty rights apply. In these cases, please contact us beforehand at service@standuhren.com.

In the event of justified defect claims, we will arrange for the return or bear the necessary costs of processing the return or subsequent performance in accordance with legal regulations.

7. Exclusion or premature expiry of the right of withdrawal

The statutory right of withdrawal does not exist or may expire prematurely in the cases provided for by law, in particular for

  • goods manufactured according to customer specifications or clearly tailored to personal needs,
  • sealed goods that are not suitable for return for health protection or hygiene reasons if their seal has been removed after delivery,
  • goods that can spoil quickly or whose expiration date would be quickly exceeded.
